It is illegal in Michigan for court clerks or employees to give you legal advice. In addition, do not expect the police or prosecutor to help you if you are the subject of a criminal investigation, are charged with a crime, or have a warrant for your arrest. Talking to the police without first consulting with your own lawyer is a huge mistake that can lead to devastating results. Hire your own personal attorney if you are charged with any crime or even if you receive a minor traffic violation. Do not just “plead guilty” if you are charged with a crime and always fight every traffic ticket in the 48th District Court and in every other jurisdiction. Most criminal matters can be handled efficiently particularly for first time offenders. There are many ways to get a criminal case under control including:

  • Reduce drunk driving charges and keep your license.
  • Avoid points for traffic tickets.
  • Crimes sealed and dismissed for youthful offenders (age 18 – under 26).
  • Request a delayed sentence or deferral with a dismissal after a period of probation.

Going out for a good time and winding up with a drunk driving case is never planned upon. In fact, getting a drunk driving is expensive, stressful and a huge inconvenience. Getting one of the Judge’s that will put you in jail for a first offense makes it even worse. If you find yourself in this situation, you need to do everything possible to be prepared for the court process. Hire an experienced drunk driving lawyer the minute that you are released from jail to get your life back on track. An experienced 48th District Court lawyer will advise you to: attend some AA meetings, begin a substance abuse program, get a report from your doctor, and compile positive documentation which depicts your good character (armed services, charity, awards, character letters).

Pursuant to the Clean Slate Law in Michigan, a person with only one (1) drunk driving case on his or her record is eligible for expungement. Contact ABDO LAW if you are charged with drunk driving or if you want to discuss your eligibility for expungement of a criminal offense.
