Traffic offenses are classified as criminal offenses or civil infractions. The list of criminal traffic offenses is extensive. Most criminal traffic violations are classified as misdemeanors which means that they can carry possible incarceration. The most prevalent misdemeanor traffic violations are: drunk driving, driving while suspended, reckless driving and leaving the scene of an accident and carry up to six (6) points. It is even more crucial to fight your traffic ticket if it is a criminal offense. In most cases, a criminal traffic offense can be lowered to an offense with lesser consequences, fines and points. Michigan Secretary of State Point System
The Michigan Secretary of State Point System assesses points to the driving record of a person found responsible or guilty to listed driving violations. Points are assessed based upon the seriousness of the offense. The following is a partial list of criminal and civil infraction offenses, along with the points that are applied, upon a finding of guilt or responsible:
Six Point Violations
- Felony involving use of a motor vehicle
- OWI (BAC .08 or greater)
- OWI with high BAC (.17 or greater)
- OWI child endangerment
- Failed to stop after personal injury accident
- Failed to stop after property damage accident
- Reckless driving
- Refusal to take a chemical test
- Fleeing or eluding a police officer
Four Point Violations
- Drag racing
- Operating while visibly impaired
- Under age 21 with any bodily alcohol content
- 16 mph or more over the speed limit
- Failure to yield/show due caution for emergency vehicles
Three Points Violations
- Careless driving
- Disobeying a traffic signal or stop sign
- Improper passing
- 11 through 15 mph over the speed limit
- Failure to stop at railroad crossing
- Failure to stop for a school bus
- Disobeying a school crossing guard
Two Points Violations
- 10 mph or less over the speed limit
- Open alcohol container in vehicle
- All other moving violations of traffic laws
