The 42-2 District Court/New Baltimore Division: Jurisdiction Over New Baltimore, Chesterfield Township, Lake St. Clair and Other Communities

The 42nd District Court has two (2) divisions. The first division, 42-1 District Court, is located in Romeo. The second division, 42-2 District Court, is located in New Baltimore, serves the remainder of the district, including Chesterfield Township, New Baltimore, Lenox Township and New Haven. These districts are the largest districts in Macomb County based upon land area covered.

Criminal, driving under the influence, and traffic matters account for much of the caseloads of the 42nd District Courts in Romeo and New Baltimore. Legal proceedings for Boating under the influence that arise on Lake St. Clair near the New Baltimore shoreline other jurisdictions (St. Clair Shores and Harrison Township) are routinely scheduled at the 42-2 District Court/New Baltimore Division as well.

Chesterfield Township: The largest community within the 42-2 District Court is Chesterfield Township with a population of approximately 45,000 residents. Chesterfield Township has a major retail presence at the intersection of Gratiot Avenue and 23 Mile Road with Kohl’s, Target, Meijer and Lowes. A long stretch of the I-94 expressway runs through the township bringing traffic to the area. In addition, a portion of Chesterfield Township is situated on Lake St. Clair.

New Baltimore: Neighboring Chesterfield Township is the lake front City of New Baltimore which is known for its vistas along the coast of Lake St. Clair’s Anchor Bay. New Baltimore was incorporated as a village in 1867 (and later a city in 1931). The City of New Baltimore is 6.7 miles in size and has a population of approximately 12,500.

Lenox Township: Lenox is approximately 40 square miles but has a sparse population of approximately 10,000 residents. It uses the police services of the Macomb County Sheriff’s Department as do other northern Macomb County communities including Washington Township, Macomb Township, Richmond Township and Ray Township. New Haven: New Haven is also located within the jurisdiction of the 42-2 District/New Baltimore Division. It is a relatively small city with a population of approximately 5,000 and covers 2.53 square miles.

42-2 District Court/New Baltimore: Demanding Criminal & Traffic Caseload

The majority of cases in the 42-2 District arise out of Chesterfield Township, the community within this district with the largest population, most traffic and major retail plazas. In 2017, 2,696 crime incidents were reported in Chesterfield Township and 748 were reported in the City of New Baltimore. Chesterfield Township reported a high number of larceny crimes, retail fraud, domestic violence, assault crimes, and traffic violations. In addition, 161 individuals suspected of driving under the influence were tested for alcohol or drugs.

Invaluable Tips if You Have a Case at the 42-2 District/New Baltimore Division

Court proceedings are worrying affairs that most people would prefer to avoid. However, if you are charged with a crime in the 42-2 District Court your appearance is mandatory. Here are a few tips about the 42-2 District Court that might help to ease your frustration:

  • Dress Appropriately: Men should wear a suit and tie in this court which is something that the presiding Judge, William H. Hackel, III, appreciates. Your case may not be heard if you are not dressed appropriately.
  • Fines and Costs: All fines and costs are DUE on the date of sentencing. By the way, fines and costs at this court tend to be much lower than imposed by other district courts in Macomb County.
  • Hire a Lawyer: Think again if you are going to court without a lawyer. Do you know that attorneys can speak at your arraignment and potentially save you thousands of dollars that a bondsman would charge? Do you know what to do at a pretrial conference, probable cause conference or preliminary examination? Do you know that if a victim does not cooperate or fails to appear for examination or trial that the case can be dismissed?
  • Get to Court Early: Criminal and traffic matters are scheduled at 9:00 a.m. at the 42-2 District Court/New Baltimore Division. However, we recommend that you get arrive when the doors open at 8:30 a.m. This court building has conference rooms which we can use with our clients to get prepared and relax.
  • Appearance NOT Required for Traffic Tickets: Less than 10% of all traffic tickets are contested. This statistic is hard to believe considering the amount that someone stands to save in insurance premiums by fighting a traffic ticket to avoid points. Numerous traffic tickets are issued within the 42-2 District Court jurisdiction, especially arising out of Chesterfield Township and on the I-94 expressway. If you hire a lawyer for a traffic ticket (speeding, careless driving, disobeying traffic control device, improper lane use, failing to yield), your lawyer can appear on your behalf and you do not need to appear. However, you are required to appear if you are charged with a criminal traffic violation such as DWLS, Leave Scene Accident, Reckless Driving.
